These Terms govern your purchase of goods from www.divingmagnets.com, operated by Diving Magnets (Pty) Ltd. Please read them before ordering — by placing an order you agree to be bound by them.
These Terms give the same rights to every buyer, whether you are a business or a consumer. Nothing in them takes away rights the law gives you.

We manufacture and supply professional-grade neodymium holding and positioning magnets and related accessories to commercial diving, inspection and industrial customers worldwide.
We do not subscribe to any industry code of conduct or self-regulatory body.
2. These Terms
These Terms, together with our Privacy Policy and Shipping & Returns policy, form the agreement between you and us. If anything in another document conflicts with these Terms, these Terms apply.
We may change these Terms from time to time. The version in force when you place your order is the version that applies to that order. Each version carries a number and an effective date at the top of this page.
By using this website or communicating with us electronically, you agree that our electronic communications satisfy any legal requirement that communications be in writing.
You can save or print these Terms at any time. We keep a record of every order for 7 years; email orders@divingmagnets.com for a copy of yours.
3. Products, ratings and descriptions
We describe each product as accurately as we can. Photographs are illustrative; finishes and fittings may vary slightly.
Stated pull ratings are the maximum holding force measured under optimal laboratory conditions — direct, full-surface contact with a clean, flat, dry, sufficiently thick mild-steel plate. In real use the achievable holding force is almost always lower.
Factors that reduce holding force include surface curvature, rust, paint, marine growth, coatings, sediment, partial contact, thin or non-solid steel, angle of pull, and shock loading. These are explained in our Technical Specifications and Safe Handling Guide, which form part of the product description. You should read them before selecting a magnet for a task.
Never select a magnet on its rated pull alone. Always allow a substantial safety margin for the conditions you are working in.
4. Your order and when a contract is formed
- You place an order through the website, or accept a quotation we have issued.
- We acknowledge your order by email. This acknowledgement confirms receipt — it is not yet acceptance.
- A binding contract comes into existence only when we accept your order by dispatching the goods, or by confirming acceptance in writing.
If we cannot supply an item — for example it is out of stock, or a price or description was materially wrong — we may decline or cancel your order before dispatch. If you have already paid, we will refund you in full, promptly and without charge.
5. Prices, currency and VAT
Prices are shown on the website and are confirmed at checkout before you pay. Prices exclude delivery, which is calculated and shown separately before you complete your order.
- South African orders are priced and charged in South African Rand (ZAR).
- International orders are priced and charged in United States Dollars (USD).
- The merchant outlet country is South Africa.
Diving Magnets (Pty) Ltd is not a registered VAT vendor. No VAT is charged on our prices and our invoices do not reflect VAT.
Customs duties, import taxes, clearance fees and any other charges raised in the destination country are not included in our prices and are your responsibility. See Shipping & Returns.
6. Payment
We accept the following payment methods:
- Visa and Mastercard, processed by Yoco Technologies (Pty) Ltd (ZAR).
- PayPal (USD) — www.paypal.com.
- Electronic funds transfer (EFT) to our bank account, for orders where this option is offered.
Card payments are processed over an encrypted connection by our payment providers. We never receive or store your card details on our systems. More about Yoco's security: www.yoco.com.
Where payment is made by EFT, we begin processing your order once cleared funds reflect in our account.
7. Delivery, risk and ownership
Delivery timeframes, carriers and costs are set out in Shipping & Returns. Any delivery date we give is an estimate and not a guaranteed time of arrival.
Risk of loss or damage passes to you when the goods are delivered to you or to a person you have nominated to receive them. Ownership passes to you once we have received payment in full.
If we have not delivered within 30 days of accepting your order, and we have not agreed a later date with you, you may cancel the order and receive a full refund including any delivery charge you paid.
Strong permanent magnets are classified as UN2807 magnetized material for air transport. This can restrict the carriers, services and destinations available for your order, and may affect transit times.
8. Cancelling and returning an order
You may cancel an order at any time before dispatch, for any reason, and receive a full refund including delivery charges.
After delivery, you may return any unwanted item within 30 days of delivery for a refund of the price you paid for the goods. To qualify, the item must be unused, in as-new condition, complete with all parts, and in its original packaging.
- Tell us first — email orders@divingmagnets.com or WhatsApp us, quoting your order number.
- Repack the item securely in its original packaging.

- You arrange and pay for return carriage on an unwanted item.
- We refund the price of the goods. Original delivery charges are not refunded on an unwanted item.
- We refund within 14 days of receiving the returned item, using the same payment method you used.
- Until we receive the item it remains your responsibility, so please use a tracked service and pack it well — these are heavy items.
This 30-day right is our own policy and is more generous than the 7-day cooling-off right that section 44 of the Electronic Communications and Transactions Act gives you on electronic orders. You keep that statutory right in any event — you do not have to rely on our policy if the statutory one suits you better.
This section covers unwanted goods. If an item is faulty, damaged or not as described, section 10 applies instead and you do not pay return carriage.
9. Our quality guarantee
We guarantee that our products are free from defects in materials and workmanship, and that each magnet achieves its stated pull rating when tested under the optimal conditions described in section 3.
If a product fails to meet that standard, tell us and we will repair it, replace it, or refund you — the choice is yours — and we will cover the cost of returning it.
The guarantee does not cover:
- Reduced holding force in use caused by the conditions described in section 3 — surface condition, curvature, coatings, partial contact, angle of pull or shock loading.
- Loss of a magnet at sea, or loss of any item it was attached to, however that loss occurs.
- Use beyond the rated capacity, or use in a way the Safe Handling Guide advises against.
- Fair wear and tear, accidental damage, or corrosion resulting from failure to rinse and dry the magnet after use in salt water.
- Modification, disassembly or repair by anyone other than us.
10. Faulty, damaged or incorrect goods — your statutory rights
Separately from our guarantee, South African law gives you rights we cannot take away. Under sections 55 and 56 of the Consumer Protection Act you are entitled to goods that are of good quality, in good working order, free of defects, and reasonably suitable for the purpose they are ordinarily intended for.
If goods fail that standard within six months of delivery, you may return them at our cost and choose a full refund, a replacement, or a repair.
Please inspect your order on arrival. If anything is damaged in transit, missing or incorrect, tell us within 7 days at orders@divingmagnets.com with photographs where possible, so we can take it up with the carrier. Reporting later does not remove your statutory rights.
11. Safe use and your responsibilities
These are powerful permanent magnets and they can cause serious injury if handled carelessly. They can trap fingers and hands with great force, damage electronic and magnetic equipment, and interfere with pacemakers and other implanted medical devices.
You are responsible for reading our Safe Handling Guide, for ensuring anyone who uses the product is competent to do so, for selecting the right product with an adequate safety margin, and for complying with the health and safety rules that apply to your operation.
Our magnets are holding and positioning aids. They are not certified lifting equipment and must never be used to lift, support or suspend loads above people, nor as the sole means of securing a load or a person.
12. Our liability to you
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for loss caused by our gross negligence, for fraud or fraudulent misrepresentation, for harm caused by unsafe or defective goods under section 61 of the Consumer Protection Act, or for anything else that the law does not allow us to limit or exclude.
Subject to that, and because the use to which our products are put is under your control and not ours, our total liability arising out of any order is limited to the amount you paid for the goods in question.
Again subject to the paragraph above, we are not liable for loss of profit, loss of contracts, loss of vessel or equipment downtime, costs of retrieving lost or dropped equipment or objects, or any indirect or consequential loss.
We take care to keep the website accurate and available, but we do not guarantee that it will be uninterrupted or error-free.
13. Intellectual property
All content on this website — text, images, drawings, specifications, logos and layout — belongs to us or our licensors and is protected by South African and international copyright and trade mark law. You may not copy or reuse it commercially without our written permission.
14. Your personal information
We handle your personal information in accordance with our Privacy Policy, which explains what we collect, why, how long we keep it, who we share it with, and the rights you have.
15. Events beyond our control
We are not liable for delay or failure to perform caused by events outside our reasonable control — including carrier and customs delays, port or airline disruption, industrial action, power failure, extreme weather, or acts of government. If such an event occurs we will let you know and agree a revised timeline with you, and you may cancel and be refunded for anything not yet delivered.
16. General
- If any part of these Terms is found to be unenforceable, the rest continues to apply.
- If we do not insist on a right straight away, we do not lose it.
- You may not transfer your rights under these Terms without our written consent. We may transfer ours, for example if our business is sold, provided your rights are not reduced.
- These Terms are the entire agreement between us about your order and replace any earlier discussions.
- Only you and we have rights under these Terms — nobody else may enforce them.
17. Complaints and disputes
We would much rather resolve a problem directly. Please contact us first at orders@divingmagnets.com or on +27 71 628 6430 and give us a fair chance to put it right — we aim to acknowledge every complaint within 2 business days.
If we cannot resolve it between us, a consumer may refer the matter to the National Consumer Commission or the Consumer Goods and Services Ombud (CGSO) — www.cgso.org.za, 0860 000 272, or to any other dispute-resolution body with jurisdiction. Referring a dispute does not affect your right to go to court.
18. Governing law and jurisdiction
These Terms and any dispute arising from them are governed by the law of the Republic of South Africa, and are subject to the jurisdiction of the High Court of South Africa, Western Cape Division, Cape Town. If you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer protections of the country you live in.
